What happens next?

The Registrar may conduct an investigation or appoint an investigator to undertake a formal investigation.

The investigator engages with the complainant and the practitioner to determine the specifics of the complaint, collect any records and evidence, and meet with others identified through the course of the investigation.

A file containing all of the information gathered is prepared and referred to the Preliminary Proceedings Sub Committee (Screening Committee) of the Fitness to Practice (FTP) Committee. The file is reviewed by the Screening Committee for evidence of professional misconduct and to establish if a prima facia case exists.

The purpose of this stage of the process is to enable complaints which are frivolous, vexatious, misconceived or lacking in substance to be summarily disposed of. Should the Screening Committee determine that a prima facie case exists the case will be referred to the Fitness to Practice Committee hearing.
