Committee

(1) The Council shall establish a Fitness to Practise (FTP) Committee to conduct inquiries into allegations of professional misconduct.

 

(2) The Council shall appoint members of the Fitness to Practise Committee which shall be composed of five persons:-

 

  • Two persons who are members of the PHECC Register drawn from a standing panel nominated by the members:
  • A medical professional drawn from a standing panel
  • A consumer representative drawn from a standing panel nominated by a consumer organisation(s); and
  • Chairperson (Council Member) who shall have access to legal advice (Legal Advisor)

  (3) Council shall appoint panel members of a sub-committee namely the preliminary proceedings sub- committee to support the work of the Fitness to Practise Committee.

 

(4) The Preliminary Proceedings Sub Committee (PPC)shall be composed of six persons:-

  • Three persons who are members of the PHECC Register drawn from a standing panel nominated by the members;
  • One member from another healthcare profession, drawn from a standing panel, nominated by the profession(s);
  • A consumer representative drawn from a standing panel nominated by a consumer organisation(s); and
  • Chairperson (Council Member – non EMT) who shall have access to legal advice (Legal Advisor).

(5) The function of the Preliminary Proceedings Sub Committee will be to consider all allegations and, following examination of the allegations in the manner set out in these rules, to either:

 

a)   find there is no case to investigate,

or

b)   refer the allegation to the Fitness to Practise Committee for investigation,

(6) A person is not eligible to be a member of the Preliminary Proceedings Sub Committee and a member of the Fitness to Practice Committee at any one time or in relation to any one matter.
